Buying property does not give you residency
A foreign buyer can generally own a United States home, but the deed creates no visa, green card, work permission or public-healthcare entitlement. The State Department describes B-2 status as temporary tourism and specifically excludes permanent residence: visitor status is not a retirement route.
Long-term residence must come from an independent family, employment or other qualifying immigration category. EB-5 is not a house-purchase programme: USCIS requires investment in a qualifying commercial enterprise and the creation or preservation of ten permanent full-time jobs. Seasonal owners must also track the IRS substantial-presence test; immigration permission, federal tax residence and state domicile are separate questions.
Decision rule: establish the lawful stay, healthcare and tax-residence plan before selecting a state or resort market.
Who United States suits
United States is a strong fit for buyers who already have durable immigration status—or want a seasonal second home—can fund private healthcare and mountain-property carrying costs, and treat any rental income as optional.
Look elsewhere first if the property is expected to create residence, ordinary nonresident mortgage finance is essential, public healthcare must begin on arrival, or nightly rental income must pay for the home.
What changed in 2025–2026
FinCEN's residential real-estate reporting rule was vacated by a federal court on 19 March 2026; while that order remains effective, the reports are not required and FinCEN has appealed. Domestic United States entities are also exempt from Corporate Transparency Act beneficial-ownership reporting under FinCEN's March 2025 interim rule. Neither development removes IRS reporting that can apply to foreign owners or foreign-owned United States LLCs.
Local operating rules continued to move. Placer County amended its Lake Tahoe short-term-rental programme from January 2025, and Aspen moved permit, business-licence and local-tax administration to a new platform in June 2026. These are reminders that short-term rental permission belongs to the exact property, jurisdiction and HOA—not to the resort name.
Financing and ownership costs
A foreign nonresident normally sits outside standard agency mortgage eligibility. Treat cash or a lender-specific portfolio loan as the conservative base case and obtain written terms before any non-refundable commitment. There is no single national foreign-buyer transfer tax: recording charges, title practice, property-tax assessment and closing allocations vary by state and county.
A nonresident alien's United States rental income is generally subject to 30% withholding on gross income unless a treaty or an IRC section 871(d) election changes the treatment. On sale, FIRPTA generally requires withholding of 15% of the gross amount realized; that is withholding, not necessarily the final tax. A foreign-owned disregarded LLC can also require Form 5472 with a pro-forma Form 1120, and United States real estate can create estate-tax exposure for a nonresident non-citizen.
Decision rule: compare five-year cash outlay and the after-tax exit under the intended ownership structure, not only the asking price.
Retirement practicality beyond the purchase
Healthcare is status-led and expensive. Medicare is not an arrival benefit. CMS states that a person buying Part A or enrolling in Part B on the residence route generally must be a United States resident and citizen or lawful permanent resident with five continuous years of United States residence. Marketplace eligibility also requires residence and lawful presence. Mountain hospitals provide real emergency capacity, but complex specialist care can require travel to a larger city.
Title and HOA records define the asset. Reconcile recorded title, easements, water and access rights, zoning, CC&Rs, rental permission and any leasehold or condo-hotel structure. Review HOA budgets, reserves, master insurance, deductibles, litigation, assessments and rental restrictions before pricing a unit.
Written terms must make wildfire, snow and insurance part of the budget. Check winter access, snow load, wildfire and evacuation, smoke, drainage, slope and avalanche exposure. Use FEMA flood mapping and insurer quotations. Standard policies can exclude flood and earth movement; California-side Tahoe may require a FAIR Plan plus separate difference-in-conditions cover.

The United States can deliver exceptional mountain living, but every useful answer is property-specific. These five lenses connect immigration, healthcare, ownership and resilience to the life the home must support.
Build the life around lawful time in the country
Ownership never substitutes for immigration status. A seasonal owner must also track federal tax day counts and decide whether the property remains a second home or becomes part of a state-domicile plan. Park City has the easiest large-airport access; Aspen, Jackson and Tahoe require more deliberate specialist-care and winter-transfer planning.

Treat use and income as separate propositions
Park City licensing and zoning, Tahoe's multiple jurisdictions, Jackson Hole's narrow approved areas and Aspen's permit types produce different operating rights. Verify the parcel, municipal or county rule, HOA and tax registration. A legal short-term rental nearby proves nothing about the selected home.

Fund healthcare before lifestyle
Price lawful insurance from the first day, Medicare eligibility only when it genuinely applies, and travel to a metropolitan specialist. A mountain hospital is not the same as a complete ageing-care network, especially for complex or recurring treatment.
Insure the difficult season
Obtain property-specific wildfire, snow, flood, earth-movement and liability terms before removing contingencies. Test evacuation, backup power, winter road maintenance and HOA deductibles alongside the premium.
Preserve flexibility at purchase
Favor clear title, broad layouts, sensible access and a well-funded association. Park City offers Salt Lake City proximity; Tahoe divides across California and Nevada; Jackson is the most restrictive rental geography; Aspen and Snowmass combine global prestige with high operating cost. The best retirement purchase is useful without a nightly-rental permit and sellable beyond one international buyer pool.
